Booking Conditions

Bhaya Cruises’ online instant booking will be processed via www.bhayacruises.com or www.bhayagroup.com – the Official Booking Portal of Bhaya Cruise Co., Ltd. Please read the terms and conditions carefully, as it contains information concerning your legal rights, limitations on these rights and a section regarding applicable law and jurisdiction of disputes. If you do not accept all of these terms and conditions, please do not use this website or book a product. In all booking arrangements, the person making the booking shall be deemed to have accepted this terms and conditions on behalf of the persons named in the booking.

1. Payment Terms

Payments may be made by cash, bank transfer, and major credit cards.

The credit card payment will be processed via the Secured OnePAY Payment Gateway upon confirmation. OnePAY represents MasterCard to provides online payment solutions to enterprises in Vietnam.

2. Rate condition, change, cancellation & refund policy

2.1. Change

Bhaya Cruises does not charge a fee for amending or changing the dates of an existing booking if the request is received by the Bhaya Cruises Sales Office more than 21 days before your confirmed travel date, unless stricter conditions are specified at the time of booking.

For requests made within 21 days of departure, Bhaya Cruises will attempt to honor your request. However, availability is not guaranteed, and additional fees may apply.

2.2. Cancellation & Rate condition

2.2.1. For all bookings

Cancellation policy varies depending on the selected rate plan and/or promotion period (Last Minute, Early Bird, etc). The applicable cancellation policy for each booking will be based on the type of cruise and the conditions specified at the time of booking, either on the website or via written communication with the cruise support team.

In case, for any reason, no cancellation policy is set forth for a booking, the following standard cancellation policy shall apply.

2.2.3. Black Friday Early-Booking cancellation policy

Partially Refundable Rate Condition

During certain promotion period including (but not limited to) Black Friday Early Saver deal, the promotion rate requires a deposit amount of which 30% of total booking value will be non-refundable immediately upon booking confirmation.

Cancellation Policy

Cancel after reservation: 30% of total booking value will be charged.

Cancel within 90-61 days from cruising date: 60% of total booking value will be charged.

Cancel within 60 days from cruising date, or in case of No-Show: 100% of total booking value will be charged.

Notes

This Black Friday early-booking policy overrides the standard cancellation policy for bookings made during the promotion.

All other standard terms and conditions (payment methods, passenger information, liability, children policy, etc.) remain in full effect.

2.2.4. Non-Refundable Rate with Limited Date Change

For selected promotions or rate plans, bookings may be made under a non-refundable rate condition with limited date change flexibility.

In case of cancellation, modification, or no-show, 100% of the total booking value will be charged.

Guests may request only one (1) reschedule of the cruise date, provided the request is made within the timeframe specified in the applicable rate policy. Any further request to change or cancel the booking after the first reschedule may be refused, and full cancellation terms under the original booking will apply.

Rescheduling is subject to real-time availability and applicable terms and conditions. The new cruise date must fall within the eligible travel period, and any price difference for the new cruise date will apply. No refund will be provided if the new cruise date has a lower rate. If the new cruise date incurs a surcharge and the guest declines to pay, the original booking will remain unchanged.

Special offers and promotional benefits are non-transferable and may not apply if the new cruise date falls outside the applicable promotional period.

All changes must be confirmed in writing by Bhaya Cruises Sales Office via a valid email address with domain @bhayacruises.com or @bhayagroup.com.

2.2.5. Special Offers – Availability, Confirmation & Usage

All special offers and promotional rates are subject to availability at the time of booking and may be limited in quantity. Availability will be confirmed by Bhaya Cruises’ Sales Office via official email communication.

In the event of any discrepancies between the promotional offer and the website, the details confirmed via official email shall prevail. Promotional offers are non-transferable, not combinable with other promotions, and cannot be exchanged for cash or other services.

Usage and Refund Policy for Special Offer Inclusions:

Case 1: Unused Benefits (Guest’s Choice): Any Special, Exclusive, or Promotional benefits outside of standard cruise inclusions not utilized by the guest by choice are strictly non-refundable and non-transferable. These inclusions carry no cash value and cannot be used to deduct from or discount the total package price.

Case 2: Unused Benefits due to Force Majeure: If a Force Majeure event (including but not limited to storms, government orders, or pandemics) prevents the guest from using the special offer inclusions or the entire package, the refund is strictly limited to the actual amount paid to Bhaya Cruises. Special, Exclusive or Promotional benefits outside of standard cruise inclusions are complimentary and hold no cash value; therefore, they are not eligible for any refund, credit, or cash compensation.

Case 3: Used Benefits prior to Force Majeure: If a guest has already utilized Special, Exclusive or Promotional benefits before a cruise is cancelled due to Force Majeure (including but not limited to storms, government orders, or pandemics), a full refund of the package price is not applicable. The standard market value of these services at the time of use will be deducted from the total package price. The refund will apply only to the remaining net cruise portion.

2.3. Refund

Bhaya Cruises provides services as a unified, non-separable package. If any portion of the package (including but not limited to hotel stays, transfers, or tours) has already been utilized by the guest, a full refund of the total package price is not applicable. The final refund amount in all cases will be calculated based on services rendered and must be formally confirmed in writing by Bhaya Cruises’ Sales Office.

Once confirmed with Bhaya Cruises, the guest will receive their refund via the same payment method used for the original transaction. It can take up to 15-21 days for the refund to be credited to the guest’s account.

To ensure clarity and fairness, the following refund calculations apply:

Transaction Fees: All refunds are issued minus the transaction fees charged by third-party payment providers (see table below).

Actual Amount Paid: For purchases made with discounted rates, refunds apply only to the actual net amount paid to Bhaya Cruises.

Special Offers & Promotional Packages: For bookings involving special offers, exclusive benefits, or promotional packages, refunds are governed strictly by the cases outlined in Section 2.2.5. Specifically:

  • Used promotional services will be deducted at their standard market value.
  • Unused promotional services due to Force Majeure are non-refundable and carry no cash value.

2.4 Deposit and Final Payment Policy

For all reservations made with a partial deposit, the remaining balance must be paid in full no later than forty-five (45) days prior to the scheduled check-in date, unless otherwise agreed in writing by Bhaya Cruises. Failure to remit the outstanding balance by the applicable due date shall constitute a material breach of this agreement. In such event, the reservation shall be deemed automatically canceled without further notice, and Bhaya Cruises reserves the right, at its sole discretion, to release the reservation from its system, terminate all related obligations, and apply the applicable cancellation policy to any deposit paid.

3. Currency

All prices and charges are quoted in USD.

4. Insurance

Bhaya Cruise Co., Ltd has an obligation to buy the civil liability insurance of the owner of the cruise for passengers in accordance with current Vietnam Laws and regulations. We strongly recommend all passengers purchase their own appropriate insurance before departing for Vietnam and before their trip on Bhaya Cruises.

5. Other conditions

The maximum occupancy for any cabin or suite is two (2) Adults and one (1) Child under 12 years of age. Additional charges may apply for occupancy by more than two (2) guests per room or suite.

Bhaya Cruises may allow children to stay in the same cabin/suite with their parents either with or without an extra mattress. Our policy is not to charge for children under two (2) years of age. Children aged from three to eleven (3 – 11) sharing a cabin/suite with two adults on an extra mattress will be charged extra, and limited to one additional child per cabin/suite only. Two children under 12 years old and sharing a private cabin/suite are charged 75% of the adult rate. Children 12 years old and over will be charged at the adult rate.

Confirmed arrival and departure dates, the number of cabins and passengers, passenger’s names, passport and visa numbers, cabin category (SGL/DBL/TWIN), and special requirements (e.g. gifts, dietary requirements, etc.) must be provided by passengers not less than seven (7) days prior to check-in.

6. Corkage Charge

We do not permit corkage. All kinds of soft and hard drinks are sold on board, you are recommended to use drinks provided by our cruises. Any guest who brings/consuming food &/or beverages from outside will be charged corkage fee.

7. Bhaya Cruises Limitations of Liability

Bhaya Cruises shall be liable only for its own negligence. Bhaya Cruises shall not be liable under any circumstance for any force majeure such as acts of war, civil commotion, riots, strikes, acts of terrorism or acts of sovereign states or governments or any cause beyond the control of Bhaya Cruises, regardless of whether it is on the vessel or off the vessel. Bhaya Cruises does not provide insurance for personal injury, luggage loss, or medical evacuation.

The responsibility of Bhaya Cruises for damage to or loss of the Passenger’s luggage, belongings, or property, including, without limitation, clothing worn by the Passenger, even if temporarily in the custody of Bhaya Cruises, is limited to the maximum sum of US$300 per person. Under no circumstances will Bhaya Cruises be responsible for loss or damage to valuables if not placed in security boxes at the reception desk.

Bhaya Cruises shall not, under any circumstances, be liable to the passenger for damages for emotional distress, mental anguish or psychological injury of any kind, when such damages were neither the result of a physical injury to the passenger, the result of the passenger having been at actual risk of a physical injury, nor intentionally inflicted by Bhaya Cruises.

Bhaya Cruises reserves the right to cancel or alter a tour when unforeseen circumstances arise. Such circumstances include but are not limited to war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, adverse weather and/or traffic conditions, government action, or for any reason outside of our control. In these circumstances, Bhaya Cruises accepts no liability where cruises are forced to cancel or alter due to any unforeseen circumstance.

Where a tour is canceled prior to the departure date, according to the clauses above, Bhaya Cruises shall endeavor to offer the nearest possible alternative tour (subject to a refund or further payment to cover the cruise difference).

The law governing the contract is the law of Vietnam. In case of any dispute, between a passenger and Bhaya Cruises or a third party or controversy, claim, the laws of Vietnam shall apply.
