Terms & Conditions

Bhaya Cruises’ online instant booking will be processed via www.bhayacruises.com or www.bhayagroup.com - the Official Booking Portal of Bhaya Cruise Co., Ltd. Please read the terms and conditions carefully, as it contains information concerning your legal rights, limitations on these rights and a section regarding applicable law and jurisdiction of disputes. If you do not accept all of these terms and conditions, please do not use this website or book a product. In all booking arrangements, the person making the booking shall be deemed to have accepted this terms and conditions on behalf of the persons named in the booking.

Please refer to section VIII for applicable terms and conditions for the Bhaya Cruises' 17th Anniversary Check-in Minigame. 

I. Payment Terms

Payments may be made by cash, bank transfer, credit card, or Paypal.

The credit card or PayPal payment will be processed via the Secured OnePAY Payment Gateway upon confirmation. OnePAY represents MasterCard to provides online payment solutions to enterprises in Vietnam.

II. Rate condition, change, cancellation & refund policy

Change

Bhaya Cruises does not charge a fee to amend or change the dates of an existing booking, as long as the request is received by Bhaya Cruises Sales Office more than seven (7) days ahead of your confirmed travel date.

If you request changes within seven (7) days or less of your confirmed travel date, Bhaya Cruises will attempt to honor your request; however, changes may be subject to an additional fee.

Cancellation & Rate condition

Cancellations become effective only once the Bhaya Cruises Sales Office receives the notification of cancellation in writing. The cancellation policy shall be applied strictly following the Rate Condition noted during the booking confirmation process. In case the policy is not presented, the following rules shall apply. 

Promotion code: Use of the promotion code is eligible for the Flexible Rate option only (unless otherwise specified by Bhaya Cruises in writing). The promotion code may not be combined with any other sale, promotion, discount, code, coupon, and/ or offer. Bhaya Cruises reserves the right to refuse any request to combine a promotion code with other ongoing offers at any time. 

Non-Refundable Rate:

The bookings cannot be amended or modified and no refunds are available.

Promotional Rate: Promotional rates include rate plans with special discounts or offers applied. These rates include but are not limited to rate plans with displayed name (on Bhaya Cruise websites) that contains Flash Sale, Last Minute, Early Bird, Special Offer, Flexible Rate (with promotion code applied), etc... The cancellation or modification of any booking chosen by one of the above-mentioned rate plans or others with similar nature shall apply in accordance with the booking conditions presented for the chosen rate plan which could be found in (i) the first step of the booking process, (ii) repeated in the last step of the booking process (confirmation landing page after successful payment or inquiry submitted), and (iii) confirmation email sent to customers' provided email address as they complete the online booking process.

Flexible Rate:

Free cancellation until 8 days prior to the cruise date. Cancel within 4-7 days before the cruise date: 50% charge. Cancellation made within the 3 days before the cruise date or in case of a no-show: 100% charge.

Others:

Any booking made with Rate Condition not clearly specified shall apply the following cancellation policy unless otherwise confirmed by Bhaya Cruises in writing.

Refund

Once confirmed with Bhaya Cruises, the guest will receive their full refund minus the transaction fee third-party charges. When applicable, a refund will be made via the same payment method that the guest made payment to Bhaya Cruises. It can take up to 15 days for the refund to be credited to the guest’s account. For purchases made with discounted amounts, refunds are only applicable for the actual amount customers paid to Bhaya Cruises.

The purchased service is sold as a package, no refunds will be made for unused services or no-shows.

Packages with seaplane tickets included: cancellation, modification, and passengers' weight limit for ticket calculation

Cancellation or change only becomes effective once Bhaya Cruises Sales Office receives the cancellation notice in writing.

Should it become necessary for you to cancel or change the booking of any package which includes seaplane transportation, the terms, and conditions for cancellation or change of seaplane ticket(s) will be applied strictly following the cancellation and change policy of Hau Au Aviation on this link.

Please note that due to the size and capacity of our aircraft (12 passenger seats), the variability of passenger and luggage weights are significant in determining the number of passengers for each flight. Therefore, as recommended by the CAAV, Hai Au Aviation requires the actual weight of passengers and luggage in load calculations. Therefore, Hai Au Aviation has a ticket policy for overweight passengers who weigh above 110 kilograms with details explained here.

III. Currency

All prices and charges are quoted in USD unless otherwise indicated.

IV. Insurance

Bhaya Cruise Co., Ltd has an obligation to buy the civil liability insurance of the owner of the cruise for passengers in accordance with current Vietnam Laws and regulations. We strongly recommend all passengers purchase their own appropriate insurance before departing for Vietnam and before their trip on Bhaya Cruises.

V. Other conditions

The maximum occupancy for any cabin or suite is two (2) Adults and one (1) Child under 12 years of age. Additional charges may apply for occupancy by more than two (2) guests per room or suite. 

Bhaya Cruises may allow children to stay in the same cabin/suite with their parents either with or without an extra mattress. Our policy is not to charge for children under two (2) years of age. Children aged from three to eleven (3 - 11) sharing a cabin/suite with two adults on an extra mattress will be charged extra, and limited to one additional child per cabin/suite only. Two children under 12 years old and sharing a private cabin/suite are charged 75% of the adult rate. Children 12 years old and over will be charged at the adult rate.

Confirmed arrival and departure dates, the number of cabins and passengers, passenger's names, passport and visa numbers, cabin category (SGL/DBL/TWIN), and special requirements (e.g. gifts, dietary requirements, etc.) must be provided by passengers not less than seven (7) days prior to check-in.

VI. Corkage Charge

We do not permit corkage. All kinds of soft and hard drinks are sold on board, you are recommended to use drinks provided by our cruises. Any guest who brings/consuming food &/or beverages from outside will be charged corkage fee.

VII. BHAYA CRUISES LIMITATIONS OF LIABILITY

Bhaya Cruises shall be liable only for its own negligence. Bhaya Cruises shall not be liable under any circumstance for any force majeure such as acts of war, civil commotion, riots, strikes, acts of terrorism or acts of sovereign states or governments or any cause beyond the control of Bhaya Cruises, regardless of whether it is on the vessel or off the vessel. Bhaya Cruises does not provide insurance for personal injury, luggage loss, or medical evacuation.

The responsibility of Bhaya Cruises for damage to or loss of the Passenger’s luggage, belongings, or property, including, without limitation, clothing worn by the Passenger, even if temporarily in the custody of Bhaya Cruises, is limited to the maximum sum of US$300 per person. Under no circumstances will Bhaya Cruises be responsible for loss or damage to valuables if not placed in security boxes at the reception desk.

Bhaya Cruises shall not, under any circumstances, be liable to the passenger for damages for emotional distress, mental anguish or psychological injury of any kind, when such damages were neither the result of a physical injury to the passenger, the result of the passenger having been at actual risk of a physical injury, nor intentionally inflicted by Bhaya Cruises.

Bhaya Cruises reserves the right to cancel or alter a tour when unforeseen circumstances arise. Such circumstances include but are not limited to war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, adverse weather and/or traffic conditions, government action, or for any reason outside of our control. In these circumstances, Bhaya Cruises accepts no liability where cruises are forced to cancel or alter due to any unforeseen circumstance.

Where a tour is canceled prior to the departure date, according to the clauses above, Bhaya Cruises shall endeavor to offer the nearest possible alternative tour (subject to a refund or further payment to cover the cruise difference).

The law governing the contract is the law of Vietnam. In case of any dispute, between a passenger and Bhaya Cruises or a third party or controversy, claim, the laws of Vietnam shall apply.

VIII. Bhaya Cruises' 17th Anniversary - Check-in Minigame Terms & Conditions

Each participant shall enter the competition via Instagram or Facebook by posting (in public mode) photos of them with the check-in booths provided by Bhaya Cruises, tagging Bhaya Cruises official Instagram/ Facebook account and using official hashtags #bhayacruises #happytoseayou .

The participants must show the post as proof of participation to the Cruise Manager on their trip. Eligible participants will be confirmed by the Cruise Manager and receive a gift of 500,000 vnd drink voucher as the prize for successful participation. The limitation of 01 drink voucher for all drink bills of 01 cabin is applied. 

Bhaya Cruises will not be held liable for any failure of receipt of entries. Bhaya Cruises takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.

To the extent permitted by applicable law, Bhaya Cruises shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and Bhaya Cruises and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available.

In the event of unforeseen circumstances beyond Bhaya Cruises’s reasonable control, Bhaya Cruises reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.

Bhaya Cruises's decision is final. No correspondence will be entered into.

The participants’ photos, name and social media username may be posted on the social media profiles of Bhaya Cruises after the mini-game./.
